The Case We Had to Win Twice!
Jobling Gowler recently acted in a personal injury case which has received significant media attention following a court hearing earlier this year.
In this case we represented a boy who suffered a a life-limiting and permanent injury at a leisure venue. Jobling Gowler accordingly pursued legal action on two counts. Firstly, against the venue for failure to comply with health and safety regulation, and secondly against the adults present for substandard supervision of the children during the activity. The court found the owners of the venue guilty for failing to display appropriate warning signs as well as carry out required risk assessments. However, the Judge decided to dismiss the claim against the adults supervising the activity on this occasion.
The owners of the venue attempted to appeal the ruling against them. Subsequently, Jobling Gowler decided to enter a cross-appeal against the ruling which dismissed the role of the supervising adults in the accident. In March 2018 we appeared at the High Court, where our appeal was successful. The Judge reversed the previous ruling and entered Judgment against the adults for failing to adequately supervise the children. Furthermore, the Judge proceeded to dismiss the appeal of the owners and so ultimately, both parties prosecuted by Jobling Gowler were found guilty.
Commenting on the case, our Senior Partner, Simon Gowler, stated: “This was a difficult case, both in terms of the emotions which ran high on both sides, and in relation to the law.” The Judge has since referred the matter back to the local County Court. The Court will now assess the value of the damages, which are expected to run into six figures.
