How dental negligence claims work

Building your claim
There are two stages to a dental negligence claim:

- Valuing your claim – Once we establish that you were a victim of dental negligence, we will then work out how much compensation you may be entitled to (sometimes referred to as ‘establishing quantum’).

Time limits for dental negligence claims
You will generally have three years from the time the negligence occurs (or the date when you become aware of it) to make a claim.
However, there are some limited circumstances where you may have longer to claim. For example, if you need to claim for someone who was under 18 at the time of negligent treatment, you will have until their 18th birthday to make a claim and they can then pursue their own claim up until they turn 21.
