How dental negligence claims work

Free initial consultation

For many people we work with, this is their first time dealing with a lawyer, let alone making a compensation claim. Your free initial consultation is your chance to explain your situation and ask any questions you might have, so you can move forward with confidence.

You can tell us exactly how you believe you have been let down with your dental care and our team will then talk you through your legal options and the various ways of funding your claim, including whether a conditional fee agreement (‘no win, no fee’) may be appropriate.

Building your claim

There are two stages to a dental negligence claim:

  1. Investigating your claim – We will look at all of the evidence, including your dental records, general medical records and independent examinations to help establish if you have grounds for a claim.
  • Valuing your claim – Once we establish that you were a victim of dental negligence, we will then work out how much compensation you may be entitled to (sometimes referred to as ‘establishing quantum’).

By taking a detail-orientated approach and building your claim carefully from the outset, we can significantly increase your chances of a positive outcome that gets you the compensation you deserve as quickly as possible.

Settling your dental negligence claim

In almost all dental negligence cases, we are able to secure compensation with an out-of-court settlement. This means you do not have to attend a court hearing and will typically receive compensation much faster and with lower legal costs.

In those rare cases where court proceedings are required, our litigation team have the experience and hard-headed approach needed to effectively represent you in court, giving you the best chance of a favourable outcome.

Time limits for dental negligence claims

You will generally have three years from the time the negligence occurs (or the date when you become aware of it) to make a claim.

However, there are some limited circumstances where you may have longer to claim. For example, if you need to claim for someone who was under 18 at the time of negligent treatment, you will have until their 18th birthday to make a claim and they can then pursue their own claim up until they turn 21.

If you are unsure whether you still have time to claim, please don’t hesitate to contact a member of our team.
