Medical Negligence Funding

We know from experience that the cost of funding a medical negligence claim is one of the greatest concerns for many clients. We can, however, advise you fully of your funding options and the option that is most suitable for you.

We are able to offer a number of schemes to fund medical negligence claims. We have a contract with the Legal Services Commission for Clinical Negligence which means that we are able to offer Public Funding where applicable.

Some of the schemes that we use to help people fund their claims include:

Public Funding (or Legal Aid as it used to be known)

We are one of the only firms in East Cheshire to have been granted a contract by the Legal Services Commission for Clinical Negligence. That contract means that we are able to assist clients who are financially eligible and who have a potential case, on a publicly funded basis.

We will need to assess whether you may be eligible for Public Funding at the outset of the claim.

Legal Expense Insurance

Many people have existing legal expense insurance as part of their household insurance policy. You will need to check the details of the policy that was in place at the date of the negligent treatment to see if you are covered. Not all policies cover clinical negligence cases. It is also important that you are aware that many policies have strict time limits on how quickly a potential case has to be reported to the insurers. If you think that you have legal expense insurance cover it is important that you contact us without delay so that we can offer help with contacting your insurer.

Conditional Fee Agreement

In many cases we are able to enter into a conditional fee agreement which would cover the cost of our fees for investigating and pursuing your claim. This means that if the case is not successful we will not charge you for our fees. If necessary, we can enter into a similar arrangement with a barrister so that his or her fees are only paid in the event of a successful claim. We will need to tailor any conditional fee agreement to your specific case.

At Jobling Gowler we are able to offer, in suitable cases, a conditional fee agreement with delegated insurance backing which is available from the outset. Although you will be required to meet the costs of disbursements as and when they are incurred (for example the cost of obtaining copies of your medical notes and records and the cost of obtaining medical reports from independent experts) under the terms of the insurance scheme those out of pocket expenses will be paid for by the insurers at the conclusion of your claim in the event that your claim is not successful. In the event that your claim is successful then those out of pocket expenses should be recoverable from the other side at the end of the claim.

Private Funding

If none of the options set out above are available to you then you can still pay us privately to investigate your case. We will give you clear estimate at the outset for the work you wish us to undertake and, if appropriate, can agree with you an upper limit for each stage of the investigation.
